Probate itself is the opening of a court case to administer a will or intestate (without will) estate. Probate is often required to transfer property that is titled solely in the decedent's name, including real property and retirement, investment and other accounts without named beneficiaries.
Guardianship & Conservatorship
A legal Guardian is appointed to make decisions for a person regarding their health, medical treatment and living situation. A Conservator is appointed to make decisions regarding a protected person's finances and property. The Guardian handles the person and the Conservator handles the person's money.
A Guardian/Conservator may become necessary for a number of reasons including a disabled child turning 18 or any other child or adult who is otherwise incapable of handling their own decisions. A Guardian and/or Conservator appointment can sometimes be avoided if Powers of Attorney were put in place at a time when the person had capacity to do so.
At Bordeaux & Boyes we are able to guide you and your loved ones through the process of applying for a Guardianship, Conservatorship or both so that you can legally better take care of those who need it. Guardians and Conservators are both in a fiduciary relationship with the protected person and have to file regular reports with the Courts.
